Terms of Service

These Terms of Service (“Terms”) govern your use of the software, AI tooling, and messaging services (collectively, the “Services”) provided by Galvyn, LLC (“Galvyn,” “we,” “us”). By using the Services you agree to these Terms.

1. Lawful Use

You agree to use the Services only for lawful purposes and in compliance with all applicable laws, regulations, and the policies of any third-party platforms through which the Services are delivered.

2. Opt-In and Opt-Out

Galvyn only messages individuals who have given explicit opt-in consent. Recipients may opt out at any time by replying STOP to any message, or by emailing yatharth@galvyn.com. Once opted out, the recipient will not receive further messages from the relevant service.

3. Third-Party Platforms

Some Services are delivered through third-party platforms such as WhatsApp. Your use of those platforms is also subject to the terms and policies of the relevant platform operator, including the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy. Galvyn is not responsible for the availability or behavior of third-party platforms.

4. Intellectual Property

The Services, including all related software, content, branding, and documentation, are owned by Galvyn, LLC or its licensors and are protected by applicable intellectual property laws. No license is granted to you except as expressly set forth in these Terms.

5. “As Is” Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GALVYN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GALVYN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. GALVYN’S TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

7. Indemnification

You agree to indemnify and hold harmless Galvyn, LLC and its officers, directors, employees, and agents from any claim, liability, damage, or expense (including reasonable attorneys’ fees) arising out of your use of the Services or your breach of these Terms.

8. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

9. Changes

We may update these Terms from time to time. The “Last updated” date above indicates when the Terms were last revised. Continued use of the Services after a change constitutes acceptance of the revised Terms.
